Crypto Brokerage
A crypto broker is considered a financial service provider under the Financial Service Act when:
- he buys or sells tokens on secondary market for clients;
- on a commercial basis (i.e. permanent, for-profit economic activity);
- tokens can be classified as financial instruments (e.g. asset tokens that qualify as equity / debt securities or derivatives in some cases of stable coins)
- Financial service providers need to comply with their code of conduct, organisational requirements and they need to check if prospectus and licensing requirements are applicable.
